Terms and Conditions for Jarir Reader Service

1. Jarir Reader Service ("Service")

Allows the user to purchase, download and read books, magazines and newspapers ("Publications") in electronic format available in the "Store" of the service. The service allows the user to browse available publications, purchase them and pay according to the payment method of the device used for purchase.

The service is available through the following channels or means:

• Application for smartphones and tablets from Apple devices with iOS (iPhone, iPad and iPod)
• Application for smartphones and tablets running Android

2. License to Download and Read Publications

Upon successful completion of the purchase and payment for the required publications, the user has obtained a license to download and read the publications through the service's programs and applications, and each user can download publications on a maximum of three (3) devices. The user is not entitled to attempt to copy or transfer any of the publications or any part of their contents to other services or devices.

3. User Account

The user must create a service account through the website or one of the applications to save their purchases from the service and enable downloading publications on related programs and applications.

By registering for the service, the user certifies that they are at least 18 years old. The username or password of the user may not be shared with any other person.

By registering for the service, the user undertakes that the data registered in the account is correct and kept up to date.

By registering for the service, the user undertakes to comply with all systems, laws and ethics related to use and agrees to bear full responsibility for activities performed through the service.

4. Exchange and Returns

Electronic books cannot be exchanged or returned.

5. Technical Support

The customer must contact the technical team when there is any error or defect in the purchase process within only two days from the date of the transaction to enable them to help.

6. User Conduct

The user may not use the service except for legal purposes and in accordance with these terms and any operating rules established by Jarir Bookstore. Jarir Bookstore reserves the right to refuse service, terminate accounts or cancel orders at any time at its sole discretion, including but not limited to based on any activity by any subscriber that violates these terms or applicable law.

7. Copyright and Intellectual Property

All content included as part of the service such as text, graphics, logos, button icons and images; in addition to any classification thereof, as well as all programs used on the site are the property of Jarir Bookstore or its suppliers and are protected under the laws of Saudi Arabia and international laws; including but not limited to copyright laws and other laws that protect intellectual property and property rights. The user also agrees to comply with and abide by all copyright and other owner notices, interpretive comments or other restrictions included in any content, and may not make any changes therein. Any other party providing content owns the copyright of the original content it owns; including but not limited to the rights of publications delivered or otherwise made available to the user through the service except as permitted, and the user acknowledges that they have not acquired any ownership rights by downloading publications accessed through the service unless expressly requested under copyright law or permitted by the features of the service and Jarir Reader program. The user may not modify, reverse engineer, publish, transmit, display, participate in the transfer or sale of, create derivative works from the site content or publications, or commercially exploit the site content or publications or any part thereof or provide it to any other party without the express permission of Jarir Bookstore and the owner of such content. We do not grant the user any licenses - express or implied - regarding the intellectual property of Jarir Bookstore or its licensors, except as expressly permitted under these terms and conditions.

8. International Use

The service is controlled, operated and managed by Jarir Bookstore from its offices in Riyadh - Saudi Arabia. If the service is used from any location, the user is responsible for compliance with all local laws and also agrees that they will not use the service or any publications accessed through the service in any country or in any manner prohibited according to any applicable laws, restrictions or other regulations.

9. Third Party Content

Jarir Reader has no editorial control over publications. Jarir Bookstore will close access to and/or remove any material believed in good faith to be subject to copyright and illegally copied and transmitted to our site. Any opinions, advice, statements, services, offers, information or other content expressed or made available by third parties, including those available in publications displayed by the service, belong to their author(s) or publisher(s) and are not the property of Jarir Bookstore.

Jarir Bookstore does not guarantee the accuracy, completeness or usefulness of any publications, and will not be liable for any loss or damage resulting from your reliance on information obtained through the service or from publications. The service may include links to other websites and third-party external sources. Jarir Bookstore assumes no responsibility for communications or materials available on such linked sites and these links are provided for convenience only. The user is solely responsible for understanding any terms and conditions that may apply when you visit or place an order through any third-party external site.

10. Service Modifications

Jarir Bookstore reserves the right at any time and from time to time to modify or discontinue the service or any part thereof, temporarily or permanently, without notice. The user agrees that Jarir Bookstore shall not be liable to them or to any third party for any modifications to, suspension or discontinuance of the service.

11. Pricing

The price of any item of publications on the service may be increased or decreased between the time it was published and the time it was actually purchased. In the event of a discrepancy or pricing error, Jarir Bookstore reserves the right to modify and/or change at any time without obligation to notify users.

12. Disclaimer of Warranties

The service and all publications are provided on an "as is" and "as available" basis. Jarir Bookstore and its affiliates, suppliers, licensors and agents expressly disclaim all warranties of any kind, whether express or implied; including but not limited to warranties of merchantability, fitness for a particular purpose, performance and non-infringement. Without limiting the foregoing, Jarir Bookstore or its affiliates, suppliers, licensors or agents make no warranty that (a) the service will meet your requirements, (b) the service will be uninterrupted, timely, secure and error-free, (c) information that may be obtained from use of the service or that may be included in publications will be accurate and reliable, or (d) the quality of any publications or service will meet your expectations. The user is solely responsible for obtaining and maintaining an efficient internet connection. Jarir Bookstore assumes no responsibility for the inability to download content due to internet connection error or failure and any materials downloaded or otherwise obtained through use of the service are at the user's sole discretion and risk, and they will be solely responsible for any damage to the computer system or mobile device used or loss of data resulting from downloading any such material. Any advice or information - whether oral or written - obtained by you from Jarir Reader or through or from the service does not grant any warranty.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Jarir Bookstore or its affiliates, suppliers, licensors or agents shall not be liable, under any theory or law, for any indirect, incidental, punitive or consequential damages. To the maximum extent permitted by applicable law, Jarir Bookstore's total liability for any claims arising from your use of the service or publications or otherwise shall be limited to the fees paid by you to Jarir Bookstore in respect of the portion of the service or publication giving rise to the claim.

14. Indemnification

The user agrees to defend, indemnify and hold harmless Jarir Bookstore and its licensors, suppliers and any other content providers and their directors, employees, workers and agents from and against all claims, losses, expenses, damages and costs, including attorneys' fees arising from or resulting from (a) your use of the service or publications, (b) your violation of the terms or (c) any activity related to the user account including negligence or misconduct by you or by any other person who has accessed the service or publications using the user account.

15. Monitoring

Jarir Bookstore reserves the right to, but is not obligated to, monitor the service to determine compliance with these terms and any operating rules established by Jarir Bookstore, and compliance with any law, regulation or authorized government request. Without limiting the foregoing, we reserve the right to remove any content that we may find - at our sole discretion - to be in violation of the provisions of this agreement or to be undesirable or in violation of obligations of Jarir Bookstore's licensors.

16. Termination

Jarir Bookstore or the user may terminate this agreement at any time. Without limiting the foregoing, Jarir Bookstore may - at its sole discretion and without liability - terminate your password or use of the service for any reason; including but not limited to if Jarir Bookstore believes that the user has violated or acted inconsistently with the letter or spirit of these terms. Any termination of your access to the service under any provision of these terms may be effected without prior notice, and Jarir Bookstore may immediately suspend and delete your account and all related information and/or bar any further access to the service.

17. Miscellaneous Provisions

These terms and conditions, rules, guidelines, licenses and other disclaimers published on the site constitute the entire agreement between Jarir Bookstore and the user regarding use of the service and supersede and replace all prior written or oral agreements between the parties regarding the subject matter of this agreement. These terms shall be governed by the laws and legislation of Saudi Arabia, regardless of conflict of laws principles thereof, and the parties are subject to the judicial jurisdiction in Saudi Arabia. No waiver by any party of any breach or default under this agreement shall be deemed a waiver of any prior or subsequent breach or default.

18. Notice of Changes

From time to time, Jarir Bookstore may modify these terms to keep them updated and current with Jarir Reader products and services. Please refer to the website periodically for any changes. The update date listed above at the beginning of this agreement is used to alert you to recent modifications. Your access to or use of the service after any such update is evidence of your agreement to be bound by these changes.
